Hangi birine kızayım? Ekşi Sözlük, Özgürlük ve Cezalar Üzerine...
Bir kaç gündür eğer Ekşi Sözlük adresine giderseniz, siteye Türkiye'den erişimin mahkeme kararı ile durdurulduğunu göreceksiniz. Burada Ekşi Sözlük'ün ne olduğu, nasıl olduğuna detaylı olarak girmeyeceğim. Internet'te bu konuda bir çok bilgi bulabilirsiniz. Aslına bakarsanız, bu siteyi sıklıkla da ziyaret eden birisi değilim. Arada bir hiç hakkında bir şey bulamadığım kavramları/kişileri buradan bulmuşluğum vardır. Ancak, kendi kendine bir marka olmuş, Internet kullanıcılarının bir çoğunun referans siteler listesine girebilmiş, yapısı ve içeriği ile bir açığı kapatmış, bununla birlikte 'first mover advantage'dan yararlanmasını bilmiş, ağızdan ağıza hızla yayılmış (belki Alper sözlüğü bu yönden de yazar) ve bu yaygınlığı ve yarattığı kullanıcı kitlesini sitesindeki reklam yada sponsorluk çalışmaları ile nakte çevirmiş bu sitenin Türkiye'nin öncülerinden olduğunu yadsıyamam.Bir kaç gündür çeşitli kişisel blog sayfalarında yada ciddi internet sitelerinde bu siteye erişimin durdurulması konusu hararetli biçimde tatışılıyor. Durdurma sebebi, uyuşturucunun kullanımın özendirilmesi. Bu tartışmalara kısaca göz gezdirdiğinizde tartışmaların bir kaç eksende aynı anda, iç içe devam ettiğini görebilirsiniz. Bunlar;
- Her hangi bir Internet sitesine sansür/kapatma uygulanabilir/uygulanamaz, erişim engellenebilir/engellenemez
- Cümle aleme Internet'e sansür koyarak rezil olduk/olmadık
- Bu zihniyet Google'ı da kapatır/kapatamaz

- Siteye, şöyle şöyle yaparak erişebilirsiniz, bu kararı verenler zaten Internet'ten anlamazlar/anlarlar
- Bu durdurmanın arkasında 'derin güçler' vardır
- Bu durdurma çarpık yönetimin ürünüdür/değildir
- Ekşi Sözlük'e yapılan bir kampanya ile desteklenmelidir/desteklenmemelidir
Kısaca, hukuki bir konudan onlarca tatışma konusu yaratabilen başarılı bir toplumuz. Ama sapla samanı ayıramadığımız gibi, konuları birbiri içine o kadar çabuk harmanlayabiliyoruz ki nerede başlayıp, nereye vardık kaybediyoruz. Bu tartışmalar denizinde, irili ufaklı, az ya da çok kızdığım o kadar çok şey var ki.... Sırasıyla yazacağım:
- Birincisi ve en önemlisi, konu hukuki bir konu. Ne avukatlık mesleğini, ne de bu konuya sebep detay yasaları biliyorum. Ama sağda solda, konudan bir haber bir çok adam, benim gibi bilgisiz olmalarına rağmen, benim cesaret edemeyeceğim bir iş yapıyorlar. Çünkü, benim kızdığım eleştiri yapılması değil. Hukuk gibi bir teknik konuda, konuyu hukuk boyutunda ehliyetsiz kişilerin doğru/yanlış yorumlamaları/değerlendirmeleri, insanları 'doldurmaları'. Bkz. bir kaç ay önce bu ülkenin başbakanı, çok yanlış bir şekilde yargının verdiği kararları 'keyfince' halkın gözü önünde değerlendirdi, eleştirdi, kendi yargısı ile yanlış olduğunu ifade etti. Eminim, bugün Ekşi Sözlük hakkında yargı kararı konusunda yorum yapan bu kişilerin çoğu, o zaman başbakanı o kararları eleştirdiği için ayıpladı, yapılanı uygun bulmadı. İlk blog'um da yazmıştım trafik konusunu. Bir benzeri durum var aslında: Başkası yapınca 'tuu kaka', ama konu biz olunca 'herşey mübah'!!
- İkinci konu ise daha derin: Internet ve özgürlük. Bir çok kişinin yorumların okudum. Ekşi Sözlük konusu, bir şekilde internet ve özgürlükler girdabına kapılmış sürükleniyor. Hatta
Siyah Kahve bu konuda bir protesto kampanyası dahi başlattı. Internet'in özgür bir platform olduğunu, herkesin herşeyi istediği gibiyazıp, söyleyebileceğini, dünyada bizdeki erişimi durdurma gibi bir bağnazlığın olmadığını söyleyenlerin sayısı oldukça fazla. En önemli dayanak noktalarında birisi de Google: Google'da istenilen her türlü zararlı bilgiye bir kaç tıklama ile ulaşabiliyor olmanız. Ancak malesef, elma ile armutu birbirine karıştırıyoruz. Google, internet'te oluşturulan sayfalara erişim sağlayan bir pencere. Google, Terms Of Service bu konuyu detaylıca açıklıyor okumak isteyenler için. Yani, Google bu sayfaları üretmediği gibi, içeriğinin de muhatabı değil. Muhatab, siteyi yapan, yöneten, yürüten kişilerdir. Google'dan Marissa Mayer'in bir röportajı var BBC'de çıkan. Google'ın konuya nasıl yaklaştığını açıkça ortaya koyan bir röportaj ve söylenen sözler çok önemli: "Internet is not a private place!" İlgili röportaj Google ve privacy ile ilgili ama, Mayer şöyle diyor: "Internet gerçek hayat gibidir, bazı şeyleri 'UNDO' yapamazsınız." Ben konuya buradan yaklaşarak şunu söylüyorum. Ekşi Sözlük'te bugüne kadar onlarca hakaret yazısı gördüm. Buraya bu yazıları yazanlar da, bu siteyi yönetenler de bu yaptıklarından sorumludur, bu sorumluluk üstlenilmelidir. Ekşi Sözlük'teki bir çok yararlı bilgiyi kesinlikle reddetmiyorum. Ancak, kurunun yanında yaşında yanması her zaman muhtemeldir, acı bir talihsizlik te olsa mümkündür. Bizler gibi, kampanya başlatan Siyah Kahve'dekiler gibi, onlarca Internet sitesi editörü ya da blog sahibi kişiler gibi düzgün insanlar, yanlış kullanımlara müsade etmediğimizde, telif hak ve mülkiyetlerine saygı duyarak hareket ettiğimizde, warez, çocuk pornosu gibi yasal olmadığı gibi sapkın içeriğe izin vermediğimizde, gençlerin beyinlerini boş, tehlikeli fikirlerle dolduran bilgilere dur dediğimizde; yasa koyucuların da seve seve düşünce ve ifade özgürlüğünü öldürmekten öte, destekleyecek yasaları birer birer, kendiliğinden devreye alcağına eminim. - Son olarak (bu yazıyı bu kadar uzun planlamıştım :) ), bu cezayı verenlere sesleniyorum: O kadar boş bir ceza ki şu verdiğiniz... Herkes, Internet'te iki tıklama ile ekşi sözlüğe nasıl arkadan dolaşarak girebileceğini bulabiliyor! N'oldu cezanız??? O kadar büyük yaygara kopuyor ki internet ortamında şu anda Ekşi Sözlük'le ilgili, insanlar, 'yahu ne yazmış bu adamlar' diye bakmak için özellikle giriyorlar siteye! Burada eleştirdiğim konu, yasanın kendisi değil, yanlış yapılan işin kendisi değil... Kızdığım konu, mahkeme kararı sonrası verilen, caydırıcılıktan uzak, sorunu çözmeye yönelik olmaktan uzak, işin kolayına kaçan, basit ve gereksiz ceza!!! Sitenin yazarlarına ceza verilebilir, yöneticilerine verilebilir, ilgili sayfalar kaldırılabilir, vs. vs. Bu konuda hayal gücümüz geliştirilebilir eminim!
Site kapatma eylemini, Ekşi Sözlük özelinde yanlışlığa yapılacak destek olarak görüyorum. Ama kanpanyayı başlatanların da aslında benim gibi düşündüklerini, özünde aynı ana fikirden yola çıkarak bu eylemi başlattıklarını tahmin ediyor, eylemleri için saygı duyuyorum. Umarım bir yararı olur. Keşke bu konu/kampanya, Ekşi Sözlük'ün (bence) yanlış yaptığı bir konu sebebi ile başlamış olmasaydı. Keşke, yasa koyucular ceza için daha akılcı bir yöntem seçmiş olsalardı.
Ama yine de... Bence de 'Internet musluk değildir kapatılamaz!'.....
